  2. Categories of Data and Purposes of Processing
    2.1 Apple ID and User Account

    • Data Processed: Apple ID (or account information provided by the App Store), as well as information about the plants you have added.

    • Purpose: Provision of the app’s functions (e.g., assigning user accounts, synchronizing plant data), personalized plant care instructions, and management of subscriptions (free and premium versions).

    • Legal Basis: Article 6(1)(b) GDPR (performance of a contract or pre-contractual measures).

    2.2 Plant Data and Images

    • Data Processed: Information about your plants (name, location, watering interval, etc.) as well as any uploaded images of your plants.

    • Purpose: Personalized care reminders, documentation of your plant collection, and enhancing your user experience.

    • Legal Basis: Article 6(1)(b) GDPR (performance of a contract) and, where applicable, Article 6(1)(a) GDPR (consent), for instance if you upload images.

    2.3 Usage Data

    • Data Processed: Technical information (e.g., device details, operating system version, app version), log data (e.g., timestamps of app access).

    • Purpose: Ensuring operational security, troubleshooting, and app optimization.

    • Legal Basis: Article 6(1)(f) GDPR (legitimate interests), where our legitimate interest lies in providing our services securely and without errors.

  3. Use of Third-Party Providers
    3.1 Apple App Store

    • The download and management of subscriptions (e.g., premium version) are carried out via the Apple App Store. In the event of payment transactions or in-app purchases, data is processed directly by Apple. For more information, please refer to Apple’s Privacy Policy: [Link to Apple Privacy Policy].

    • We only receive from Apple the information necessary for reconciliation with our system (e.g., confirmation of a successful payment, Apple ID).

    3.2 Other Third-Party Providers

    • Apart from Apple’s services, we use OpenAI’s ChatGPT service to analyze uploaded plant images to provide plant species identification and care instructions. In this context, uploaded images are transmitted to OpenAI solely for the purpose of analysis. Beyond this specific use, all uploaded images and plant data are stored exclusively on our servers (or with hosting providers contracted by us within the EU/EEA) and are not made available to other third parties.

  4. Storage Period

    • We only store your data for as long as is necessary to fulfill contractual or legal obligations.

    • Once you delete your user account (or cease using the app), your personal data will be deleted unless statutory retention periods require otherwise.

    • Images are deleted if you remove them from the app or delete your entire account.

  5. Rights of Data Subjects
    As a data subject under the GDPR, you have the following rights in particular:

    • Right of Access (Art. 15 GDPR): You have the right to obtain information about the personal data concerning you that we process.

    • Right to Rectification (Art. 16 GDPR): You may request the correction of inaccurate or the completion of incomplete personal data concerning you.

    • Right to Erasure (Art. 17 GDPR): You may request the erasure of your personal data, provided that no statutory retention periods prevent this.

    • Right to Restriction of Processing (Art. 18 GDPR): You may request the restriction of processing under certain circumstances.

    • Right to Data Portability (Art. 20 GDPR): You have the right to receive the personal data concerning you in a structured, commonly used, and machine-readable format, and to transmit this data to another controller.

    • Right to Object (Art. 21 GDPR): You may object at any time to the processing of your personal data for reasons arising from your particular situation, provided that the processing is based on our legitimate interests.

  6. Data Security
    We implement appropriate technical and organizational measures to protect your data against unauthorized access, loss, alteration, or destruction. These measures include, among others, encryption procedures and access restrictions to our servers.

  7. International Data Transfers
    As a general rule, your personal data will not be transferred to countries outside the European Union (EU) or the European Economic Area (EEA). Should such a transfer be required (e.g., due to server or cloud locations), we ensure that suitable safeguards pursuant to Art. 44 et seq. GDPR (e.g., EU Standard Contractual Clauses) are in place.

  8. Children and Minors
    Since we do not implement a specific age restriction, minors may theoretically use the app. However, we encourage parents or guardians to monitor their minor children’s app usage. If we become aware that we are processing personal data of children without verifiable parental consent, we will delete such data as promptly as possible.

  9. Changes to this Privacy Policy
    We reserve the right to amend this Privacy Policy at any time to reflect changes in the app, legislation, or technical developments. We will inform you of any significant changes in an appropriate manner (e.g., within the app or by email).
